awhile back I recall reading a post about restrictions and rights for placing a cabin on a piece of land that had no prior building.. is there info on this available as I cannot find it again. my situation is that a land owner of property directly adjacent to mine suddenly deposited a poorly constructed clapboard cabin at the edge of my property. this construction he claimed was to be for his occasional use on a hot day, even though he lives 100 kms away. the land surrounding my property is owned by him and has been divided into lots for future sale. The placement of this abandoned ramshackle cabin was placed directly in front of my house which had originally been visible from the road . What exists now is merely a sight object designed to attract potential buyers to this small piece of land and for no other reason. If this wasn't situated where it was then passing motorists and potential buyers would only see my house and be unaware of anything.. it's is a clever ruse but a complete eyesore to me.. from what I recall reading in this forum was a law exists that restricts placement of buildings on land.. is this true ?

Each different county/province/jurisdiction has it's own particular zoning laws. If this is a concern to you, you should talk to them. I'd suggest you try to resolve it with the owner first though, just because if you get the local jurisdiction to take action on him you may create bad feelings. Your call.

Its going to depend on the country or if you are in Canada, evern different again.
Is it a cabin or a storage shed? Cabin, permit needed, storage, permit needed if you use a full foundation and/or over 200 sq feet (that can vary too)
Many places wont allow a cabin without a septic. In my area, they will, but you have to have a privy permit already and it must meet the code. If there is a well on the property, no privy allowed, full septic only.
Some area wont allow a tool shed, ie a secondary structure without first a primary structure, I think this is a Canadian deal mostly.
Do you have some covenants? We do, but not restrictive at all. I hate to tell a guy where he can put up a shed on his own property, and just the same, someones view being impeded is another sticking point with me. I don't think we have a right to be able to see something from our home, IE a mountain, valley etc by impeding another lands owners rights or use of his property. But I can see your frustration, to have a shoddy structure to look at out your front window isn't pleasant either. Out of sheer courteous, he could of made it nice and appealing to the eyes.

thanks for all the input.. this is only to attract buyers .. an abandoned building is wonderful bait to lure property seekers. he has no intention of using this derelict "shed" for anything other than bait.. at the time I encountered him placing the "shed" he assured me he was intending to use it.. the land is useless to develop where the building due to provincial environmental law.. he has been trying to unload the lot for many years..

My setbacks in the country are 10 feet with a total of 40 feet from the sides it is 60 feet from the center of the road or 30 from the property line which ever is greater in the city the side setbacks are only 5 feet I needed a zoning permit,building permit and an address to build anything on the land and it had to zoned for building If you think he is doing anything wrong contact zoning they will be happy to fine him.

I believe rDmusic is in Quebec; things could be even more different there.
This is why we do have various zoning and use laws, building codes, etc.

sorry about not establishing my location which is in Quebec in the Lanaudière Région so my question about the "cabin" would pertain only to this province.. I am sure the placement of the building is within code .. what I was curious about was the validity of being able to put anything there in the first place.. cheers rD

Sounds like a simple phone call to your town could solve this one. Either the structure is in the wrong location or does not meet code or wasn't permitted (if required). Either way it will take time and calls to get it removed.
You don't have to cite a reason for building something.
- Find your survey and measure setbacks - Find out if the building is unsafe or illegal in any way - Find out if you can buy his land cheap

I know that in Thorne township you have to be 6 feet back from the property line to build. There is also a minimum size of 300sq feet so check these with your township. Also he may have had to get a building permit and if he did not then the township will deal with him and you may not have too.
