wow I had a weird day, my husband and I just purchased a used truck and when I was talking with our insurance agent he asked about our property we purchased last yr as he wanted to know if the truck was going to be plated for farm use. As we are over 50 acres and we do have land to work we are zoned as agriculture....blah...blah....blah you get the idea. Anyways I was trying to get the truck info and found him spending much time talking about the land more. I'm fairly new at this land owning thing and found we did not have the proper insurance as we do rent out the land to cash crop just until the farmers lease runs out for this last yr. I wasn't aware that you the land owner is totally responsible if the renter of your crops goes out on the road and smucks a car going by or something or if he tips his equiptment near your ponds or creek (which I could see happen more realistically) you will be held liable for it since you are the land owner. WHAT!?? I never thought of that at all, you know were all friends......never crosssed my mind. He also brought up trespassing (funny as I was just bloging about this subject) he said there was 3 different liablities he went over.....anyway you really are risking alot when letting people use your land even the invited ones. All and all its only going to cost me about $40.00 more a yr to be safe then sorry. I really just wanted to pass it on in case any of you are renting and wasn't aware like me that for so little it can save you alot.
Thank goodness I called about truck insurance!!

Not sure about Canadian law but you may be able to have the farmer sign a waiver holding you harmless.

The enviromental portion of the insurance is very importent also,, if someone dumps a load of toxic waste on your back 40 it's your baby. I know a guy who had 2 loads of tires dumped ,,, cost him 5000 to get rid of them !!

I talked to our broker and her eyes lit up like christmas lights when I described our property to her. All the water, hay land, renting out said hay land, etc etc. "No trespassing "signs not withstanding if a hunter ignores the signs or did not "see" them, stubs his toe on a pebble and falls and in so doing shoots his leg off we could be liable. Another scenario is a snowmobiler goes through the ice of the pond.

We were able to add it to our home insurance. It is only $60/year. Not much for peace of mind.

Not much work to farm Morels.... It might be a lot of work to make a living at it though.

I picked these in 10 minutes, but there were no more. I've never eaten a mushroom that I picked myself. I'm not much of a mushroom guy, but everyone says these are worth $25 a pound, so the gatherer in me was inclined to pick them. I guess I'll see what they taste like soon....

Too many trees to farm ours, but I do plan on putting in a green house, and fruit/nut trees. For our own food and pleasure.
Anything that could attract a hungry bear, goes on the back 40.. Away from the cabin lol..

I did learn a hard lesson with auto insurance once though.
In Indiana, if you use your car/truck for work. You need commercial insurance. I used to work for a school system, and I would deliver all of the mail to the school offices, in my car. I got a free tank of gas everyday for doing it.
A lady T boned me and totaled my new car with only 7k miles on it..
I got the car out of the road, called my insurance company (young and dumb) to tell them I got in a wreck. She asked what I was doing. I said I was delivering the mail (young and dumb) she said, you can't use your car at work, you have personal insurance. I'm afraid your policy is canceled.
The officer showed up 15 mins later to file a report.

The accident legally didn't happen until 15 mins after my policy was canceled for not being commercial insurance.. I was stuck with the whole thing. A new car totaled, the loan on that car, almost lost my DL, almost had to pay the other ladies bills, because in Indiana, no insurance, it's automatically your fault on and on...
It was a bad deal to say the least. But made it out ok. But I still walk with a limp..

Lesson learned..

We gave access to a quarry owner behind our property 10 yrs ago. It was a father & son setup with 2 whole trucks & that was it. Now with the Marcellis shale (sp) gas up there, it's a full blow working quarry. Very worried that somethings gonna happen on our property where they drive thru to gain access. They have already modified the 2 track dirt road on our property into a 2 dump truck wide dirt/stone road. All without asking for our permission. No lawyers will get near the issue due to the quarry owner owning most of the county. 7 of 10 oak trees were recently knocked down & I don't know what I can do,

Need to look at the terms of the easement, it should state who is allowed to use it for what purposes, and the width of the road. If no recorded easement, they should be compensating you, or restore your property and go find another access.

Give some folks an inch they'll take a mile.
If it's your property, and you don't like it. Maybe go have a nice talk over lunch or something.

Hi Smitty,,,, Having lunch is a great idea but this Quarry is a commercial operation, who is experienced in acquiring access. The value of using other peoples land for their commercial operations is nothing new to them, it's a central part of their business.

Xplorer should assert that all final agreements, with this Quarry operator will be formalized in writing only. I think a person should be careful when allowing use of your property for commercial purposes, especially verbally because then you get stuff like this.

They are doing it for the money and nobody would expect Xplorer to offer access for free.

In general, letting the neighbors cross your land is not the same situation as letting a business cross. They should ask permission; compensate you for the use (like rental); and then restore it when they're done. And if they can't request and agree to it in writing, don't do it.

If you don't want money in the picture, then maybe you can trade access? Just be sure that it is in writing, and also consider time limits, watch out NOT to sign anything that grants access 'forever'.

I have a small farm of 30 area's that is irrigated land. Fow many years I raised vegie's and sold them at a road side market. I couldn't raise enough home grown vegie's. I could sell everything that I grew. I raised alfalfa for years also and that is what I have growing now. Farming for a hobby is fun and not sure if I would like to do it full time.
