Looking at purchasing a Older 60 year old cabin. Appears to have been generally maintained but needs some work. My question is it has no sanitary sewer system only an outdoor privy. It is also only 50 feet from the sand point for water. I am worried about fresh water contamination. I plan on getting the water tested prior to purchase. Also is it legal to sell a property with a privy and also to close to the well point?

Here in NM 50 feet is the minimum between a septic tank and a well BUT the minimum distance from a leach field to a well is 100 feet. I know of states where the distances are half of that. No idea who is right. A pit toilet is more comparable to a leach field than a septic tank. Is the well uphill from the pit at least? There can also be other restrictions on well placement.

Is a sand point well even legaly a well in your state? I dont think it is in my state. i wouldnt be drinking the water from this anyway and a new sand point well is alot easier to put in anew spot rather than moving an outhouse.

In Anchorage, any well has to be at least 100ft from any part of a septic system. And, outhouses are forbidden.
At our cabin 2hrs north of town outhouses are allowed with certain restrictions - distance to surface water and groundwater, lot line, etc. A septic system has to be constructed in accordance with Alaska state regulations and with a permit. I'm not sure what the rules are on wells since we don't have one at the cabin.
